Terms of Use
Crowd-sourced information will help the Port of Portland (“Port”) study the effectiveness of our
wildlife management program.
The Port welcomes your comments, photos, videos, or any other content that you submit ("User
Content") through or to the PDX Raptors website located at www.pdxraptors.com and all related mobile
sites and applications where these terms and conditions appear or are linked to (collectively the
"Site"), as long as the User Content complies with these terms and conditions.
By accessing or otherwise using the Site you agree to all stated website terms of use, including the
below.
User Content
You represent and agree that any User Content you submit will not violate any law or regulation, and
will not violate any right of a third party, including copyright, trademark, privacy, or publicity
rights.
The Port assumes no liability for any User Content you submit.
The Port may, in its sole discretion: (i) monitor User Content; (ii) alter, remove, or refuse to
post or allow to be posted any User Content; and/or (iii) disclose any User Content, and the
circumstances surrounding its transmission, to any third party.
For any User Content you submit, you grant to the Port a non-exclusive, sub-licensable, fully
paid-up, perpetual, irrevocable, royalty-free, transferable right and license to use, display,
perform, transmit, copy, modify, delete, adapt, publish, translate, create derivative works from,
distribute, and incorporate it into any form, medium, or technology, now known or hereafter
developed, throughout the world, all without compensation to you.
For this reason you should not submit any User Content that you do not wish to license to the Port.
You also grant to the Port the right to include the user name provided along with the User Content;
provided, however, the Port is not obligated to include such name when using User Content as
provided above.
You represent and warrant that you have all rights necessary for you to grant the licenses set forth
above.
Privacy Policy
This privacy policy is only for information the Port collects through the Site.
It does not govern information collected by the Port through off-line sources, third parties, or
from other websites maintained or sponsored by the Port.
The Port will control the exchange, storage, and use of selected personal information about you as
described in this policy.
The Information Collected.
The Site collects and retains two kinds of information about Site visitors: (1) anonymous
information that is collected automatically and does not identify any specific user, such as log on
time and pages on the Site that are visited; and (2) certain personally identifiable information
about users that is submitted voluntarily, such as names and e-mail addresses.
This information may be collected and retained in databases.
Information Used.
The information gathered is intended to help serve Site visitors better by, among other things,
improving user access, navigation, and communication.
(1) Anonymous Information.
The anonymous information collected may be used to closely monitor which areas of the Site are used
most and to determine which areas need improvement.
This information is used exclusively in aggregate form so that the Site can continue to be improved.
Anonymous Site usage statistics may be shared with others for any purpose.
Website traffic analysis software may be used to analyze Site traffic.
Such software does not create individual profiles of visitors, but collects only aggregate data.
The Site may also use cookie technologies to provide simplified access to a few areas of the Site by
allowing users to save their details on their own computers.
Cookies can be disabled or controlled by setting a preference within the user's Web browser.
Log files related to cookies record internet protocol (IP) addresses, browser types, internet
service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks
to analyze trends, administer the Site, track a user's movement in the aggregate, and gather broad
demographic information for aggregate use.
Information collected through log files is not linked to personally identifiable information of a
user.
(2) Personally Identifiable Information.
Personally identifiable information is only used to fulfill the purpose of the user’s interaction
with the Port.
If the purpose of the user’s interaction with the Port is to provide information to a specific third
party, the Port may use the information as directed by the user.
Information may also be compiled and used to customize users’ visits to the Site.
Limited Use of Information Outside the Port.
The Port will not disclose personally identifiable information to third parties, other than service
providers who are bound to use the information only to assist us in such areas as data storage and
order processing, except in accordance with the Site’s Website Terms of Use.
Users should be aware that the Port is a public agency and that personal information provided to the
Port may be subject to disclosure in accordance with public records laws.
Security.
Commercially reasonable precautions are taken to protect user information stored in the electronic
databases.
However, given the nature of the Internet and the fact that network security measures are not
infallible, the Port cannot guarantee that electronically-stored user information will never be
stolen, hacked or viewed by unauthorized persons.
The Port maintains notification procedures as part of its information security policies, to be used
in the event of a data security breach.
If the Port is required to provide notice to you of a data security breach under such policies, the
notice will be provided in electronic form to the e-mail address you have provided to us.
Links to other Websites.
The Site may include links to other websites as a convenience to users.
When these links are used to access outside websites, the user is no longer within this Site’s Web
environment and the Port is not responsible for the privacy practices or content of the other
websites.
Correcting, Updating, Deleting and Deactivating Personal Information.
If your information changes, you may contact us to correct, update or delete and deactivate our
records.
Oregon public records retention requirements may require that the Port retain a copy of a document
containing your personally identifiable information, even when your personally identifiable
information has been removed from our working database.
Changes
The Port may change these Website Terms of Use in the future.
The Port will notify you, using the e-mail address you have supplied to us, about any changes that
materially decrease the protection of your personal information.
